Per Article 7.6.1 of the Agreement between the SMCCD and the CSEA:
"An employee shall be entitled to leave without loss of pay for anytime the employee is required to perform jury duty. The employer shall pay the employee the difference, if any, between the amount received for jury duty and the employee's regular rate of pay. Any meal, mileage, and/or parking allowance provided the employee for jury duty shall not be considered in the amount received for jury duty. Any day that an employee in a bargaining unit is required to serve all or part of the day on jury duty, and when it is a day the employee would normally be required to work, the employee shall be relieved from work with full pay."
Complete the Report of Absence form for all days spent on Jury Duty Leave. Check the box next to "Jury Duty (J)", and submit court appearance verification covering the dates spent on Jury Duty Leave. Note that the court appearance verification is a form given upon completion of the jury duty and is stamped/signed by the appropriate court. Submit the Report of Absence and court appearance verification to your immediate supervisor or department head.
Per Article 17.1.4 of the Agreement between the SMC Faculty Association and the SMCCD:
"Probationary, tenured and part-time personnel are eligible for the following leaves: sick, bereavement, industrial accident and illness, personal necessity and jury duty..."
17.1.12 Immediately upon return to work, the employee shall complete the appropriate District form and submit it to his/her immediate supervisor.
Per Article 17.6 Jury Duty Leave:
17.6.1 Faculty members absent due to mandatory court appearances, except as a litigant, shall be paid their regular salaries during such absences, and all jury or witness fees are to be signed over to the District.
17.6.2 If such jury or witness fees are greater than their regular daily wages, faculty may retain the fee if they request personal leave without pay for that period of absence from duty.
17.6.3 Verification of jury duty or subpoena must be presented to the Vice President, Human Resources before the date such duty is to begin.
17.6.4 Any meal, mileage, and/or parking allowance provided to faculty for jury duty shall not be considered in the amount received for jury duty.
